Terms of Service
These Terms of Service (the "Terms") govern your use of indieappscale.com and our services (the "Service"), operated by Websody AG ("IndieAppScale", "we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
IndieAppScale helps app makers turn their apps into social media content: we generate carousel images, captions and related marketing assets from the app details and materials you provide, and — where you connect a social account — help you publish that content to platforms such as TikTok.
2. Your account
You must be at least 16 years old to use the Service. You are responsible for the activity on your account and for keeping access to your sign-in email secure. Sign-in is passwordless; anyone with access to your email inbox may be able to access your account.
3. Connected platforms (TikTok and others)
- Connecting a third-party account (such as TikTok) is optional and done through that platform's official authorization flow. We only receive the permissions you approve, and we act on your behalf only to provide the Service — for example, publishing content you created.
- You can disconnect a connected account at any time from your settings or from the platform's own security settings, which revokes our access.
- Your use of a connected platform remains governed by that platform's own terms and policies — for TikTok, the TikTok Terms of Service and Community Guidelines. You are responsible for the content you publish there.
4. Your content
You retain ownership of the app details, assets and other materials you submit, and of the content generated for you. You grant us a limited license to host and process your materials solely to operate and provide the Service. You are responsible for having the rights to the materials you upload.
5. Automatically generated content
Generated images and text are produced automatically and may be inaccurate, incomplete or similar to content generated for others. Review everything before publishing — you are solely responsible for the content you approve and post.
6. Acceptable use
You agree not to:
- Use the Service for anything unlawful, deceptive or harmful.
- Generate or publish content that is misleading, infringes others' rights, or violates the policies of the platform you publish to.
- Probe, overload, scrape or disrupt the Service, or attempt to access other users' data.
- Resell or provide the Service to third parties without our consent.
7. Plans and billing
Parts of the Service may be offered free of charge and other parts under paid plans. Prices, limits and features are described in the app and may change; changes to paid plans apply from your next billing period.
8. Intellectual property
The Service itself — including its software, design and branding — is owned by us or our licensors and protected by law. These Terms do not grant you any rights to it beyond using the Service as intended.
9. Termination
You may delete your account at any time. We may suspend or terminate accounts that violate these Terms, create risk for other users or the Service, or where required by law. Upon termination we delete or anonymize your data as described in our Privacy Policy.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation, or any particular results (including reach or engagement of published content).
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amounts you paid us in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.
12. Changes to these Terms
We may update these Terms from time to time. We will post the new version here and update the "Last updated" date above; material changes will be communicated as appropriate. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules, and disputes are subject to the courts of Canton Schwyz, Switzerland, unless mandatory consumer law provides otherwise.
